This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with:

This Privacy Policy does not apply to information handled exclusively by a third party under its own privacy policy, except where that third party processes information on our behalf.

2. Scope and Our Role
Depending on the circumstances, Probe may act as:
- A business or data controller that determines why and how personal information is processed;
- A service provider, contractor, or data processor acting on instructions from a research client; or
- A joint participant in a research project with a client, sponsor, research facility, moderator, technology provider, or other organization.
When Probe processes personal information solely on behalf of a client, the client’s privacy notice and instructions may also apply. Requests relating to client-controlled information may be referred to that client.
A study-specific consent form, confidentiality agreement, recording release, nondisclosure agreement, or privacy notice may provide additional information. Where a study-specific notice conflicts with this general Privacy Policy, the more specific notice generally controls for that study.

Unless specifically requested through a secure process, do not send Probe Social Security numbers, complete financial-account numbers, passwords, medical records, or copies of government identification by ordinary email.

When you receive compensation or reimbursement, we may collect or process:

Submitting a screener does not guarantee selection or participation. Research clients generally establish the eligibility criteria for each project.
C. Conduct and manage research
- Facilitate focus groups, interviews, surveys, product tests, and other studies;
- Coordinate research locations, technology, moderators, clients, and participants;
- Record sessions when disclosed and permitted;
- Analyze and summarize responses;
- Prepare transcripts;
- Conduct quality-control checks;
- Deliver research results and materials to the client or sponsor;
- De-identify or aggregate research findings; and
- Support follow-up research where permitted.
D. Process incentives and reimbursements
- Confirm completion of study requirements;

- Resolve payment questions;
- Prevent duplicate payments and fraud; and
- Satisfy tax, audit, and legal obligations.

- Contractual necessity: Processing is necessary to provide a requested service, administer study participation, or issue an incentive.
- Legitimate interests: Processing is necessary for participant recruitment, research administration, quality control, fraud prevention, security, client service, or business operations, provided those interests are not overridden by your rights.
- Legal obligation: Processing is necessary to comply with tax, accounting, regulatory, court, or other legal requirements.
- Protection of vital interests: Processing is necessary in a limited situation to protect an individual’s health or safety.
- Establishment or defense of legal claims: Processing is needed to protect our legal rights or respond to disputes.
You may withdraw consent for future processing when processing is based on consent. Withdrawal does not affect processing that occurred before consent was withdrawn, and it may not require deletion where another lawful basis or legal obligation applies.
7. How We Disclose Personal Information

We may provide research clients or sponsors with information necessary to:

Whenever practicable, screening reports and research findings may be coded, aggregated, pseudonymized, or de-identified. However, some studies require clients, moderators, or observers to see or interact directly with participants. Participants will ordinarily be informed when a study involves identifiable disclosure or recording.
A client may receive:

- Relevant screening responses;
- Demographic information;
- Audio, video, photographs, transcripts, quotations, or study responses;
- Attendance or completion information; and
- Other information described in the study consent materials.
Clients are expected to use participant information for legitimate research and related purposes, subject to contractual and legal restrictions.

- Interviewers;
- Research facilities;

- Translation or interpretation providers;
- Video-conference providers;

Our participant registration and profile-management tools may be hosted through Focus Pocus Software or another research-management platform. Information entered into those tools may be stored or processed by the platform provider on Probe’s behalf.
Service providers are authorized to use information only for contracted services or as otherwise permitted by law.
D. Legal and safety disclosures
We may disclose information when we reasonably believe disclosure is necessary to:
- Comply with law or legal process;
- Respond to a government or regulatory request;
- Protect the rights, safety, or property of Probe, a participant, a client, or another person;
- Investigate fraud, security incidents, abuse, or misconduct;
- Enforce an agreement; or
- Establish or defend a legal claim.
E. Corporate transactions
Information may be disclosed as part of a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, due-diligence review, or similar business transaction. A successor may continue to process information subject to this Privacy Policy or a replacement notice.
F. At your direction
We may disclose information when you request, direct, or consent to the disclosure.
8. Sale, Sharing, and Targeted Advertising
Probe does not sell participant registration profiles to data brokers or unrelated third parties for monetary compensation.
We do not disclose research-participant information for an unrelated third party’s independent direct-marketing purposes without authorization.
Certain privacy laws define “sale,” “sharing,” or “targeted advertising” broadly and may include some uses of advertising, social-media, analytics, or cross-context behavioral cookies even when no money is exchanged.
If Probe uses technology that constitutes sale, sharing, or targeted advertising under applicable law, we will provide any legally required opt-out mechanism and honor applicable browser-based opt-out signals, including Global Privacy Control signals where required.
9. Cookies and Similar Technologies
Our website and service providers may use cookies, pixels, tags, scripts, local storage, or similar technology.

You may unsubscribe from promotional emails using the unsubscribe mechanism in the message or by contacting us.
You may request that study-recruitment communications stop by contacting dataprivacy@probemarket.com. We may retain limited suppression information to ensure that we honor the request.
When text messaging is offered, message and data rates may apply. Message frequency will vary. You may opt out of nonessential text messages by replying STOP or following the instructions in the message. Replying HELP may provide additional assistance.
Opting out of one communication method may not prevent essential messages relating to a study for which you are already scheduled.
11. Research Recordings and Observation
A study may be observed or recorded by Probe, the moderator, the client, or an authorized research partner.
Recordings may include:
- Audio;
- Video;
- Screen activity;
- Photographs;
- Chat messages;
- Transcripts;
- Facial expressions;
- Voice;
- Gestures; and
- Product interactions.
Before recording, we will ordinarily provide notice and obtain any consent required by law or contract.
Recordings may be used for:
- Research analysis;
- Client review;
- Transcription;
- Quality control;
- Verification;
- Reporting;
- Training, where specifically disclosed; or
- Other purposes described in the study materials.
Study-specific consent documents may establish different retention periods, recipients, or usage rights.
12. Healthcare and Medical Research
Some market research studies concern health conditions, healthcare services, medical devices, insurance, medications, or treatment experiences.
Probe is a market research organization and is not necessarily a healthcare provider, health plan, healthcare clearinghouse, or other entity directly regulated as a covered entity under the Health Insurance Portability and Accountability Act.
HIPAA may apply when Probe processes information on behalf of a HIPAA-covered organization under an applicable agreement. Other federal and state health-privacy laws may also apply.
Participants should not disclose identifiable medical records or information beyond what is requested for the study. Study-specific notices will provide additional information when health-related data is collected.
13. Children and Minors
Our general participant panel and website are not directed to children under 13, and we do not knowingly collect personal information online directly from a child under 13 without legally required parental authorization.
Some research projects may involve children or teenagers. For those projects, we may:
- Recruit through a parent or legal guardian;
- Verify the parent or guardian’s authority;
- Obtain parental or guardian permission;
- Obtain age-appropriate assent from the minor;
- Limit the information collected;
- Restrict recordings or disclosures; and
- Apply study-specific safeguards.

14. Data Quality and Participant Responsibilities
Please provide accurate and current information. You may update your profile using the available profile-management system or by contacting us.
Probe may take reasonable steps to:
- Verify identity;
- Confirm screening responses;
- detect duplicate profiles;
- review prior participation;
- prevent fraudulent participation;
- investigate inconsistent information; and
- protect research quality.
Submitting false, misleading, incomplete, or duplicate information may result in removal from a study or panel and forfeiture of an incentive where permitted by the applicable study terms and law.
15. De-Identified and Aggregated Information
We may create aggregated, statistical, pseudonymized, or de-identified information that is not reasonably linked to an identifiable person.
We may use and disclose such information for:
- Research;
- Reporting;
- Analysis;
- Benchmarking;
- Service improvement;
- Recruitment planning; and
- Other lawful purposes.
Where required by law, we will maintain de-identified information in de-identified form and will not attempt to re-identify it except to test whether our de-identification processes are effective or as otherwise permitted by law.
16. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including research administration, legal compliance, dispute resolution, fraud prevention, client requirements, and enforcement of agreements.
Retention depends on the type of information and context.
Typical retention considerations include:
- Participant panel profiles may be retained while the profile remains active and for a reasonable period afterward;
- Probe’s current general panel practice may include retaining participant profile information for up to ten years unless deletion is requested or a longer period is required;
- Study screeners and recruiting records may be retained for project administration, quality control, client obligations, and fraud prevention;
- Recordings and transcripts may be retained according to client instructions, study consent materials, contractual requirements, or legal obligations;
- Payment and tax records may be retained for the period required by tax, accounting, and audit laws;
- Suppression records may be retained to honor communication opt-outs;
- Security logs may be retained for fraud prevention and incident investigation; and
- Legal records may be retained until related claims or obligations have expired.
When retention is no longer necessary, we may delete, destroy, anonymize, or de-identify information.
A deletion request may be denied or limited where retention is reasonably necessary to comply with law, complete a transaction, prevent fraud, protect research integrity, enforce an agreement, maintain an opt-out record, or exercise or defend legal rights.
17. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information.
Depending on the system and information involved, safeguards may include:

Probe is based in the United States. Personal information may be transferred to, stored in, or processed in the United States or another country where Probe, a client, or a service provider operates.
Privacy and data-protection laws in those countries may differ from the laws in your jurisdiction.

Business purposes
We use these categories for the purposes described in Section 5, including panel administration, recruiting, screening, conducting studies, processing incentives, communications, security, analytics, legal compliance, and service improvement.
Recipients
We may disclose these categories to the recipients described in Section 7, including research clients, sponsors, moderators, research facilities, service providers, payment providers, professional advisers, government authorities, and transaction counterparties.
Sale and sharing
Probe does not sell participant profiles for monetary compensation.
To the extent Probe uses online advertising or analytics technology that constitutes “sharing” under California law, California residents may opt out through any available cookie-preference or “Your Privacy Choices” mechanism.
Where legally required, we recognize Global Privacy Control as an opt-out signal. California guidance states that covered businesses must honor GPC as a valid request to opt out of sale or sharing.
Sensitive personal information
Probe uses sensitive information only for the purposes described in this policy, study-specific notices, and applicable consent materials.
Where legally required, California residents may request that Probe limit uses of sensitive personal information beyond those necessary to provide requested services, maintain security, process payments, prevent fraud, or perform other legally permitted functions.
22. Rights for Residents of Other U.S. States
Residents of certain U.S. states may have rights similar to those described above, including access, correction, deletion, portability, opt-out, consent, and appeal rights.
We will evaluate requests under the law applicable to the individual and processing activity.
Where required, we will provide a method to:

24. Do Not Track
Some browsers transmit “Do Not Track” signals. Because there is not a universally accepted standard for responding to all Do Not Track signals, our website may not respond to them consistently.
We will honor legally recognized opt-out preference signals, such as Global Privacy Control, where required.

These tools may compare profile or screening information against eligibility criteria established by Probe or a client.
Being identified as a potential match does not guarantee selection. Final eligibility may require manual review, follow-up screening, identity verification, scheduling availability, or client approval.
Unless otherwise disclosed, Probe does not use solely automated processing to make decisions that produce legal or similarly significant effects concerning participants.
27. Non-Discrimination
Probe will not unlawfully discriminate against an individual for exercising an applicable privacy right.
Exercising a privacy right will not generally affect eligibility for future studies. However, deleting information, restricting processing, or withdrawing consent may prevent us from maintaining a participant profile, determining eligibility, contacting you, processing participation, or issuing certain incentives.
